INTRODUCTION
These Terms & Conditions govern all proposals, agreements, and work performed by Advanced Plastering Inc. DBA Advanced Construction Contractors (“ACC”) for the Client identified in the applicable approved proposal.
These Terms & Conditions are intended to apply broadly to ACC projects and services. Certain provisions may not apply to every project type, scope of work, or service provided. The approved proposal, scope of work, exclusions, selected options, specifications, and project-specific notes shall govern the specific work being performed.
Approval of an ACC proposal through ACC’s electronic proposal approval system constitutes acceptance of the proposal, (including the scope of work, pricing, payment terms, selected options), and these Terms & Conditions, which are incorporated therein by reference and form a binding contract between ACC and the Client.
JOB SITE PREPARATION
1. ACC may perform an initial assessment of the project area prior to commencement of work in order to ascertain overall existing conditions.
2. Paintings, fixtures, furniture, window treatments, decorative items, or other belongings located near work areas should be removed or protected by Client prior to commencement of work.
3. Due to the nature of construction work and access requirements, Client understands that exterior landscaping, trees, plants, shrubs, hardscaping and exterior furnishings/improvements may be impacted or damaged during the work. ACC will take reasonable steps to avoid such damage, but Client recognizes that some damage may be unavoidable. Because of the inherent nature of the work, ACC shall not be held responsible for damages to landscaping, trees, plants, shrubs, hardscaping and exterior furnishings/improvements resulting from the work. Client agrees to relocate any furniture, furnishings, appliances and movable vegetation away from the jobsite prior to commencement of the work.
4. Client shall coordinate with alarm, security, internet, cable, or monitoring providers as necessary prior to commencement of work. ACC shall not be responsible for associated charges, interruptions, reconnection costs, or modifications required by third-party providers.
5. Certain mechanical systems or utilities may need to be temporarily shut down during portions of the work in order to prevent damage or allow proper installation.
6. In order to maintain project scheduling and workflow, ACC shall be provided reasonable access to the work area during normal working hours. Delays, restricted access, interruptions, or Client-directed stoppages may result in schedule impacts and additional costs.
GENERAL NOTES
1. Prior to commencing work, ACC shall provide evidence of current insurance coverage upon request. ACC agrees to maintain liability insurance covering personal injury in an amount not less than $50,000.00 and insurance covering property damage caused by the work provided for herein in an amount not less than $50,000.00. At the time of signing this agreement, ACC maintains the following coverage amounts for personal injury and property damage: $1,000,000.00 limit per occurrence for bodily injury and/or property damage. There is a $3,000,000.00 aggregate limit. Additionally, a $5,000,000.00 umbrella is on the policy.
2. ACC will provide Owner notice of when the work is substantially complete. Client shall notify ACC within five (5) days of the notice of substantial completion of any punch list items reasonably observable upon inspection.
3. ACC will make reasonable efforts to complete punch list items in a timely manner.
4. Delays caused by selections, changes, materials supplied by others, third-party contractors, acts of God, weather, labor shortages, material shortages, governmental restrictions, utility interruptions, unforeseen conditions, or circumstances beyond ACC’s control shall not constitute breach of agreement.
5. Client acknowledges that active construction sites involve inherent risks and disruptions. ACC shall not be responsible for damages to unsecured or unprotected personal property, vehicles, furnishings, or adjacent areas not included within ACC’s scope of work.
6. No persons other than ACC employees or authorized personnel shall access ACC scaffolding, equipment, or restricted work areas without prior authorization.
7. Any penetrations, modifications, alterations, or work performed by others that impacts ACC’s work may void applicable warranties.
8. ACC is not responsible for pre-existing conditions, improperly installed prior work, hidden deficiencies, concealed damages, substrate defects, structural deficiencies, moisture intrusion, mold, or damages not reasonably visible prior to commencement of work.
AGREEMENT TERMS
1. The date of this agreement shall be the later of the date signed by ACC and the date approved by the Client through ACC’s electronic proposal approval system. Upon approval, the proposal, (including the scope of work, pricing, payment terms, selected options, specifications, exclusions), and these Terms & Conditions shall collectively form the agreement (“Agreement”) between the parties.
2. Pricing is valid for the period stated in the applicable proposal. If no period is stated, pricing shall be valid for thirty (30) days from the date of the proposal.
3. If project commencement is delayed beyond six (6) months from proposal approval, ACC reserves the right to revise pricing, scheduling, or proposal terms due to material, labor, or market fluctuations.
4. Some damages, deficiencies, conditions, or defects may be hidden, concealed, or unknown prior to commencement of work. Unless specifically stated otherwise in the approved proposal, concealed conditions, hidden damage, structural deficiencies, substrate deterioration, framing damage, sheathing damage, moisture damage, code deficiencies, or unforeseen conditions are not included within the proposal scope and may require additional work and associated costs. Any additional work and costs must be set forth in a change order signed by ACC and the Client.
5. Any work beyond the approved proposal scope, shall require a written change order signed by Client and ACC. email
6. Approved change orders shall become part of the agreement and subject to these Terms & Conditions unless otherwise specifically stated.
7. ACC shall perform work in a professional and workmanlike manner consistent with standard industry practices.
8. Invoices and payment milestones shall be issued in accordance with the payment schedule stated in the approved proposal.
9. Payments are due in accordance with the approved proposal terms. Failure to make timely payments may result in suspension of work, scheduling delays, removal from production scheduling, or additional costs.
10. Unpaid balances over thirty (30) days may incur a finance charge of five percent (5%) per month or the maximum amount permitted by law.
11. Final payment is due upon substantial completion unless otherwise stated within the approved proposal.
12. ACC reserves the right to withhold warranties, closeout documents, photographs, lien waivers, or project documentation until final payment has been received in full.
13. This agreement constitutes the entire agreement between the parties and supersedes all prior discussions, negotiations, representations, or understandings, whether oral or written.
14. If Client believes any statement, representation, scope item, allowance, specification, or understanding is being relied upon and is not specifically included within the approved proposal, Client shall notify ACC in writing prior to proposal approval. Neither party has made, and Owner is not relying upon, any representation, warranty, covenants or promises to the other, oral or otherwise, except as expressly contained herein.
15. This agreement may not be modified except through written change order signed by the Client and ACC. This provision may not be orally waived.
16. The approved proposal scope is based upon observable site conditions and information reasonably available prior to commencement of work. ACC shall not be responsible for hidden or unknown conditions discovered during construction.
17. Additional work required due to concealed or unforeseen conditions may affect warranties if corrective work is declined by Client.
18. Advanced Plastering Inc. DBA Advanced Construction Contractors “ACC”, is registered in the state of Pennsylvania as a home improvement contractor. The official Pennsylvania home improvement registration number for Advanced Plastering Inc. is 060692, which can be verified by calling Pennsylvania Office of Attorney General’s Bureau of Consumer Protection by calling toll free within Pennsylvania 1-888-520-6680.
19. Client acknowledges that the approved proposal and these Terms & Conditions were made available for review prior to approval and Client received copies at the time of signing.
20. The Owner may rescind this contract without penalty regardless of where the contract was signed within three (3) business days of the date of signing.
GENERAL NOTES & WARRANTIES
1. Warranty coverage, durations, and applicable manufacturer warranties shall be as specifically stated within the approved proposal.
2. Manufacturer warranties are subject to manufacturer terms, conditions, limitations, exclusions, and proper maintenance requirements.
3. ACC warranties do not cover damage resulting from abuse, misuse, neglect, improper maintenance, acts of God, structural movement, third-party work, or alterations performed after completion.
4. Any penetrations or modifications performed by others after project completion may void applicable warranties.
5. Warranty claims must be submitted to ACC in writing within the applicable warranty period.
6. ACC may document project conditions and work progress through photographs, videos, reports, or other records.
7. Unless specifically stated otherwise in the approved proposal, ACC does not provide engineering, architectural, geotechnical, environmental, or mold-related services.
8. All work shall be performed substantially in accordance with applicable building codes and manufacturer installation requirements applicable at the time of installation.
PAYMENT TERMS
1. Payment schedules, deposit requirements, progress payments, allowances, selected upgrades, optional work, and contract pricing shall be as stated within the approved proposal.
2. All payments shall be made payable to Advanced Construction Contractors unless otherwise stated in writing by ACC.
ELECTRONIC APPROVAL
1. Client approval of an ACC proposal through ACC’s electronic approval system shall constitute electronic acceptance of the proposal and these Terms & Conditions and shall carry the same force and effect as a handwritten signature.
SUBCONTRACTORS
The names, addresses and phone numbers of any subcontractors that ACC anticipates working on the project, if any, are identified in the Proposal.
